Head of Weil’s Intellectual Property & Media practice Benjamin Marks has been recognized as a “Sports/Gaming/Entertainment Law Trailblazer” by the National Law Journal. He was among 29 attorneys honored nationwide and profiled in a special supplement for their respective achievements in sports, gaming and entertainment law.
In the special feature, Benjamin discussed his career litigating disputes over music rights and rates, how music licensing regulations differ depending on the market and how periodic disagreements over competitive market rates will likely continue.
Though most rights are licensed via voluntary deals, Benjamin told the publication litigation happens because “sometimes the gap between the parties’ perceptions of what a reasonable (licensing) rate would be is just too wide.”
In addition to his music licensing practice, Benjamin regularly represents clients on copyright, trademark, misappropriation, unfair competition, media law and First Amendment issues.
